These Terms of Service (“Terms”) govern your use of opskings.com and related content (the “Site”), operated by OpsKings LLC (“OpsKings,” “we,” “our,” or “us”).

By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site. These Terms cover the website only; if we engage with you for services, that engagement is governed by a separate signed agreement.

1. Use of the Site

You agree to use the Site only for lawful purposes and in a way that doesn’t restrict anyone else’s use of it. You won’t:

  • Scrape, copy, or systematically extract content (whether by bot, script, or manual download for redistribution).
  • Reverse-engineer, decompile, or attempt to derive source code from the Site beyond what’s permitted by law.
  • Probe, scan, or test the security of the Site, or attempt to bypass any access controls.
  • Send unsolicited commercial messages through forms or email addresses listed on the Site.
  • Use the Site in any way that could damage, disable, overburden, or impair it.

2. Intellectual property

The content on the Site — including the OpsKings name, logo, written copy, case studies, blog posts, photography, video, and design — is owned by OpsKings or licensed to us. It’s protected by copyright, trademark, and other laws.

You may view and share short excerpts with attribution and a link back to the original page. You may not republish, sell, or use our content for commercial purposes without our written permission.

If you submit feedback, suggestions, or ideas to us through the Site, you grant us a non-exclusive, perpetual, royalty-free license to use them without compensation or attribution.

3. No professional advice

The information on the Site — case studies, blog posts, frameworks, podcasts — is general information about how OpsKings approaches operations and software, not specific business, legal, financial, or technical advice for your situation.

Do not rely on Site content as a substitute for advice from qualified professionals who know the specifics of your business. If you implement something based on what you read here and it doesn’t work for you, that’s on you, not us.

4. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted access.

We don’t guarantee the Site will always be available, error-free, or that any defects will be corrected.

5. Limitation of liability

To the fullest extent permitted by law, in no event will OpsKings, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business, or goodwill, arising out of or related to your use of the Site — even if we’ve been advised of the possibility of such damages.

Our total liability for any claim related to the Site, regardless of theory, is limited to one hundred U.S. dollars (US$100).

Some jurisdictions don’t allow the exclusion of certain warranties or limitation of certain damages. In those places, the exclusions and limitations above apply only to the extent permitted by local law.

6. Third-party links and services

The Site embeds and links to third-party services (Calendly, Typeform, Wistia, LinkedIn, YouTube, Clutch, and others). We don’t control those services, and our linking to them isn’t an endorsement. Your use of third-party services is governed by their own terms and privacy policies.

7. Indemnification

You agree to indemnify and hold harmless OpsKings, its officers, employees, and affiliates from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of:

  • your use or misuse of the Site,
  • your violation of these Terms, or
  • your violation of any law or the rights of a third party.

8. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If a court finds any provision of these Terms unenforceable, the remainder of the Terms remains in effect.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top. Material changes will be highlighted on this page. Continuing to use the Site after changes are posted means you accept the updated Terms.

10. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including breach of these Terms. Sections that by their nature should survive termination — intellectual property, disclaimers, limitations of liability, indemnification, governing law — will remain in effect.
